If water overflows from the inspection shaft or overflow relief gully only when appliances are used, the blockage is likely in the owner’s pipes; if it overflows continuously, call Barwon Water. The account credit Barwon Water pays if a sewer spill is caused by a fault or failure within its sewerage system. The same charter says Barwon Water maintains the water service pipe from its main up to the first meter (or the boundary if the meter is more than two metres inside it); the owner is responsible for the rest, and for any meter pit, lid or cage.

The practical test is in Barwon Water’s own words: water overflowing from the inspection shaft or the gully only when appliances in the house are running points to your pipes; continuous overflow when nothing is running points to its main. Sewage inside the house is Category 3 water — sewage backup covers what is removed rather than dried.

Stormwater: yours to the legal point of discharge

Property owners’ responsibility, along with ensuring run-off does not adversely affect other properties. Roofing, gutters, downpipes, pits and underground drains on private property are a privately owned system; the City maintains its own infrastructure from the legal point of discharge. The City says it manages more than 2,450 kilometres of drains and that tree root intrusion is its biggest cause of pipe damage.

So a blocked downpipe, a broken pit or a root-choked private drain is the owner’s to fix, and water that backs up from it into the house is part of the same problem. The City says tree root intrusion, into both private and council pipes, is its biggest cause of pipe damage. Run-off onto a neighbour is also on the owner: the system must not adversely affect other properties.

The Barwon and its flood record

The November 1995 major flood, when flows from the Barwon, Leigh and Moorabool Rivers combined; June 1952 reached 5.47 m. The guide says there have been approximately 14 large floods in the region since 1852, and that significant river flooding can follow as little as 75 mm of rain over one to three days on wet ground.

The Barwon River in late 2022. The CMA says it repeatedly reached moderate flood levels in Geelong, and that gauges in Forrest, Ballarat, Meredith and Ballan measured record highs for October rainfall.

River water from the Barwon or the Moorabool is flood in the plain sense of reg 34(1): it escaped from a river onto normally dry land. Creek flooding is fast too: the council says Hovells Creek can flood Lara in under nine hours (City of Greater Geelong, Flood risks). Flash flooding where the urban drains cannot cope is a different question for the claim, because run-off that never left a waterbody is not flood under that definition. The CMA, which has floodplain management responsibilities under Part 10 of the Water Act 1989, says a floodplain officer will provide a report within 28 days of a flood advice request, and that it does not give advice over the phone. Mean 9am relative humidity, the highest month, with July 85% and May 84%; the annual mean is 75% (1995–2010). Mean annual rainfall is 456.9 mm.

Winter is when Geelong’s mornings are dampest, as in Melbourne, and damp air slows drying. The rebuild: Victorian rules

Victoria changed schemes mid-2026. Domestic Building Insurance applied to contracts signed before 1 July 2026 and generally covered up to $300,000 for homes up to three storeys, but only where the builder died, disappeared or became insolvent. Home Warranty applies to eligible contracts signed on or after 1 July 2026, covers up to $400,000 in total per home, and is not limited to those three triggers. DBI cover does not transfer to Home Warranty.
