The fifth row is the Adelaide one. Salt damp is ground moisture rising through masonry, and it is not an escape of water or a storm, so mould from it has no insured event behind it. The Adelaide page sets out how to tell salt damp from a leak before you lodge anything.

The rental damp standard

One of the prescribed minimum housing standards. The same regulation requires habitable rooms, toilets, bathrooms and laundries to be adequately ventilated, the premises to be reasonably draught proof and weatherproof, and the grounds to be effectively drained.

Two words in that standard do most of the work. “Reasonably” means the test is not perfection. And “moisture or damp” is broader than a leak: the standard does not ask where the moisture came from. Whether a particular wall meets it is a question for the South Australian Civil and Administrative Tribunal, not this site.

The maximum penalty for a landlord who does not ensure the premises comply with the prescribed minimum housing standards by the day the tenant moves in (expiation fee $1,200). Under s 67A(2) the tenant may request urgent repairs to bring the premises into compliance.

When the landlord does not act

Where disrepair not caused by the tenant is likely to cause injury, property damage or undue inconvenience and the landlord, once notified, fails to act, the tenant may recover reasonable repair costs — but only if the work is done by a licensed person who gives the landlord a report on the work and the apparent cause of the disrepair (s 68(3)(e)) — and reasonable compensation for damage to property (s 68(3)(d)). The Act sets no dollar cap. The tenant must notify the landlord of damage (s 69(1)(b)).

The condition in s 68(3)(e) is the one to plan around. The tenant can recover reasonable repair costs only where a licensed person did the work and gave the landlord a report on the work and the apparent cause of the disrepair. For mould after a leak, that means the plumber or roofer who fixes the cause writes down what the cause was, and that report goes to the landlord. Notify the landlord in writing first, with photographs.

Strata and community schemes

All buildings and building improvements on the site, against the events prescribed for home building insurance under the Insurance Contracts Act (other than subsidence) (s 30(3)(a)). The strata corporation must administer and maintain the common property (s 25(a)). A later version was not checked.

What a community corporation’s building insurance must cover, including demolition, site clearance and architects’ fees; any shortfall from under-insurance is the corporation’s (s 103(3)). The corporation must maintain the common property in good order and condition (s 75(1)(b)). A later version was not checked.

Both Acts put the common property and the building insurance on the corporation. So mould in your lot from a leak in common property follows the water to the corporation’s maintenance duty and its building policy; mould from your own fixtures is yours. Adelaide’s mould season is winter

Mean 9am relative humidity, the highest month, with June 79% and August 74%; the annual mean is 63% (1955–2010). The wettest months are July (58.7 mm), June (57.1 mm) and May (52.5 mm), of a mean annual 437.4 mm.

The dry summers are real, but the mould season is the other half of the year: the airport’s most humid mornings and its wettest months fall between May and August. SA Health’s advice for cool days is to keep the inside at least 5°C warmer than outside, because condensation on cold walls is one of the conditions it lists for mould.

For small areas, or a suitable commercial product; wear rubber gloves, avoid splashing and ventilate the area. Do not dry-brush, which can flick spores into the air. If mould returns there may be an underlying problem, and extensive contamination calls for a professional cleaner. SA Health lists condensation, high humidity, restricted ventilation and ineffective insulation among the conditions mould grows in, and suggests keeping the inside at least 5°C warmer than outside on cool days.

SA Health’s bleach mix is much stronger than NSW Health’s: 1 part bleach to 3 parts water, against 250 mL of bleach in 4 litres of water in New South Wales, where bleach is also only a second line after detergent or vinegar. Both are health department methods; they are not the same method, so follow one of them rather than mixing the two. The mould removal guide sets the states side by side.

Does an Adelaide rental have to be free of mould?

Reasonably free. The Housing Improvement Regulations 2017 set, as a minimum housing standard, that residential premises must be reasonably free from mould or other irritants, structural disrepair or other adverse effects caused, or contributed to, by moisture or damp. A landlord must ensure the premises comply by the day the tenant moves in, with a maximum penalty of $25,000.

Can a tenant in SA recover the cost of fixing a leak?

Under s 68(3) of the Residential Tenancies Act 1995, where disrepair the tenant did not cause is likely to cause injury, property damage or undue inconvenience and the landlord, once notified, fails to act, the tenant can recover reasonable repair costs, but only if a licensed person does the work and gives the landlord a report on the work and the apparent cause. What ratio of bleach does SA Health recommend for mould?

SA Health gives 1 part bleach to 3 parts water for small areas, or a suitable commercial product, with rubber gloves and ventilation. That is a much stronger mix than NSW Health's 250 mL in 4 litres, so read which department's method you are following.

Is salt damp mould covered by insurance?
