Mould removal in Melbourne: renters’ rights, winter damp and the costs

Victoria’s tenancy law names mould: structural mould breaches a rental minimum standard and is an urgent repair a renter can arrange up to $2,500. For owners, it is a winter drying problem.

The qualifier that runs through every row is “caused by or related to the building structure”. A leaking roof, rising damp, a failed shower membrane or no working exhaust fan are the kinds of cause the words point at; mould from drying clothes inside with the windows shut all winter is harder to attribute to the building. Whether a particular case qualifies is for VCAT, not this site.

The minimum standard and the urgent repair

Every room in the rented premises. It is one of the rental minimum standards, and Consumer Affairs Victoria says that from 25 November 2025 a property must meet them before it is advertised.

Listed as fault or damage that makes the premises unsafe or insecure. The same definition includes a burst water service, a serious roof leak, flooding or serious flood damage, and a failure to comply with the rental minimum standards.

Put together, those two provisions mean structural mould in a Melbourne rental is both a breach of a minimum standard and an urgent repair. Consumer Affairs Victoria says urgent repairs must be made immediately. Put the request in writing, with photographs, and keep a copy.

The most a renter can arrange and be reimbursed for urgent repairs, when the rental provider cannot be got to do them (s 72(1)); reimbursement is due within 7 days of written notice (s 72(2)(c)). Consumer Affairs Victoria says urgent repairs must be made immediately and non-urgent repairs within 14 days of a written request.

If the rental provider cannot be got to act, you can arrange the repair and be repaid the reasonable cost up to $2,500. For mould that can mean two trades: the one who fixes the cause (a plumber or roofer) and the one who removes the mould and dries the structure, often two separate invoices. Use licensed trades and keep every invoice.

Apartments: the owners corporation’s duty

And the chattels, fixtures, fittings and services related to it. Section 47(1) extends the duty to a service in a lot that benefits more than one lot and the common property, and s 59(1) requires reinstatement and replacement insurance for all buildings on the common property.

So a leak from a roof, a riser or other pipes that are common property is the owners corporation’s to repair, and its building policy is the one that responds. Where the apartment is rented, the Residential Tenancies Act lets the rental provider join the owners corporation to a Tribunal application about damage to adjoining common property (s 75A). Melbourne’s mould season is winter

Mean 9am relative humidity, the highest month, followed by July (81%) and May (79%); the annual mean is 72% (1970–2010). Mean annual rainfall is 536.2 mm on 86.1 rain days.

Melbourne’s most humid mornings are in June, July and May. Damp winter air slows drying and feeds condensation on cold surfaces. After a winter leak, the drying takes longer than the same job in summer; the day count is the number to ask about on the quote.

Cleaning it: the Better Health Channel’s method

“Do not dry brush the mouldy area”, and vacuum only with a HEPA filter. It lists good ventilation, a shower cap, rubber gloves, eye protection, overalls, suitable footwear and a P1 or P2 mask; says pregnant women, children and people with weakened immune systems or chronic lung disease should not remove or be present; finds household detergent or white vinegar sufficient in many cases; warns never to mix bleach with ammonia, acids or other cleaners; and says to consult a mould remediation professional if large areas of regrowth occur.

On testing, the same department’s position is that where mould is visible it is generally not considered necessary to test for it in the home (Better Health Channel (Vic), Mould and your health). After a flood, it advises asking your insurer before cleaning or disposing of water- or mould-damaged items. For a renter, the useful comparison is with the $2,500 urgent repair cap: a small-room clean sits well inside it; a job that includes drying a wet wall may not.
