Queensland’s rental law is plain about mould. A rental must be free of damp and mould. Fixing mould caused by the property is an emergency repair. And if the landlord cannot be reached, a tenant can arrange the repair up to an amount equal to four weeks’ rent. The exception that runs through the table is mould the tenant caused. The regulation’s own example is a failure to use an installed exhaust fan. Mould from a leaking roof or leaking pipes is on the other side of that line: the Residential Tenancies Authority says the property manager or owner is typically responsible for cleaning it and paying for repairs.

The minimum housing standard

Not applying to vermin, damp or mould caused by the tenant, for example by failing to use an installed exhaust fan. Item 1 of the same schedule requires premises to be weatherproof and structurally sound; they are not structurally sound if a floor, wall, ceiling or supporting structure is affected by significant dampness. The 2025 Regulation commenced on 1 September 2025 and replaced the 2009 Regulation.

Addressing mould caused by problems with the property, in general tenancies. The RTA says that if mould is caused by problems with the property, such as a leaking roof or leaking pipes, the property manager or owner is typically responsible for cleaning it and paying for repairs, and that the risk rises after severe wet weather and natural disasters.

The standard makes the landlord’s duty in s 185 concrete: the lessor must maintain the premises maintain the premises in a way that the premises remain fit for the tenant to live in and in good repair, and ensure they comply with the minimum housing standards (Residential Tenancies and Rooming Accommodation Act 2008 (Qld) s 185(3)(a)). Report mould and its cause in writing, with photographs; the written notice is what the reimbursement and any tribunal application run from.

The most a tenant may incur for emergency repairs they arrange where the lessor cannot be notified or does not repair in a reasonable time (s 218(2)). The tenant may require reimbursement or direct payment by written notice with the documents, and may apply to the tribunal if the lessor does not comply within 7 days (s 219(2)–(3)).

Units: the body corporate’s building policy

Body Corporate and Community Management (Standard Module) Regulation 2020 (Qld) s 198(2) · current as at 1 August 2025, read 22 September 2026

For a scheme on a building format plan or a volumetric format plan. Section 198(3) requires the policy to cover damage and the costs incidental to reinstatement, including taking away debris and architects’ fees, and to provide for reinstatement to the condition when new. Section 195 defines damage to include damage from storm and water.

So in a Brisbane scheme on a building format plan, the building damage behind mould from a common-property leak is a body corporate question, and its policy covers damage from water. Your contents are yours. Where the lot is rented, the tenant deals with the lessor, and the lessor with the body corporate. Brisbane’s mould season is summer

The wettest month, followed by March (149.2 mm) and January (140.0 mm), of a mean annual 1,065.2 mm on a short record (1999–2026). Mean 9am relative humidity is 63% for the year, on an 11-year series (1999–2010).

The same page says bleach is not recommended because it is not an effective mould killer (though it helps with other organisms from floodwater), that detergents or white vinegar can do an effective job, and that an N95/P2 respirator is for a lot of mould or for people with allergies; standard dust masks do not protect against spores.
